Boumediene recognizes a constitutional right to challenge Guantánamo detention

In Boumediene v. Bush, the US Supreme Court held that Guantánamo detainees had a constitutional right to habeas corpus and that the existing substitute review process was inadequate. Detainees and their lawyers had continued litigating after earlier attempts to restrict court access. The ruling protected a means of contesting confinement before a judge; it neither closed the prison nor ordered every detainee’s release.
