Rasul v. Bush establishes access to federal courts for Guantánamo detention challenges

The US Supreme Court ruled that federal courts had jurisdiction to consider challenges to the legality of foreign nationals’ detention at Guantánamo. The decision reversed a major barrier faced by detainees and their lawyers and enabled further habeas litigation. It concerned statutory access to judicial review, not an order freeing all prisoners. In Hira’s framework, defending such basic rights is part of resisting the exceptional treatment of Muslim populations under the War on Terror.
