Fereshta Ludin wins a constitutional challenge to exclusion from teaching

Germany’s Federal Constitutional Court held that Baden-Württemberg lacked a sufficiently definite statutory basis to exclude a teacher for wearing a headscarf. Fereshta Ludin’s challenge contested the loss of professional opportunity because of religious dress. The ruling did not establish an unconditional nationwide right to teach while wearing a headscarf: it left legislatures room to regulate. The case nevertheless made Muslim women’s agency and equal access to public employment central public issues.
