Muslim women’s employment cases expose disputes over neutrality policies

The Court of Justice of the European Union delivered judgments in the Achbita and Bougnaoui cases. It distinguished general workplace neutrality rules from a customer’s wish not to receive services from a headscarf-wearing employee. Such a customer preference was not a genuine occupational requirement. Amnesty criticized the implications for women facing exclusion. The cases show contestation over supposedly neutral policies, not an unconditional authorization of every headscarf ban.
