The Prevention of Crime (Tribal and Village Areas) Ordinance gives district governors the power to levy collective fines against tribes or villagers deemed to have abetted an offense or the offender’s flight or to have “failed to render all assistance in their power to discover the offenders or to effect their arrest.” The ordinance holds the head of a tribe responsible for all of its members, as well as the “area” within which the tribe is located, and delegates to him police powers—obliging him to report any crime committed in the “area of his tribe or sub-tribe” to the district governor, and to arrest or produce for arrest any member of the tribe charged with an offense.
